Welcome to SthirApp. These Terms and Conditions ("Terms") govern your use of our loan management application ("App") and services. By accessing, downloading, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

SthirApp provides a digital platform for managing loans, tracking collateral, and maintaining transaction records. The App is designed for financial institutions and individual lenders to manage their lending operations efficiently.

Our services include: - Loan management and tracking - Collateral valuation and management - Digital contract generation and storage - Transaction recording and reporting - Customer and payment management - Automated reminders and notifications

You must be at least 18 years old and have the legal capacity to enter into binding contracts. If you are using this App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must provide accurate, complete, and current information during registration. Any false information may result in immediate suspension of your account.

You are responsible for maintaining the confidentiality of your PIN and login credentials. You agree not to share your access credentials with anyone. You are fully responsible for all activities that occur under your account.

You must immediately notify us of any unauthorized access or security breach. We are not liable for any loss or damage resulting from your failure to protect your credentials.

You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations. You shall not:

• Use the App for any illegal, fraudulent, or harmful activities
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or attempt to derive source code
• Create derivative works or modifications of the App
• Transmit malicious code or conduct attacks
• Violate intellectual property rights
• Harass, threaten, or harm other users
• Provide false information or misrepresent your identity
• Violate lending laws or regulations of your jurisdiction

Your personal data will be processed according to our Privacy Policy. We implement industry-standard security measures to protect your data, including encryption and secure authentication.

You acknowledge that: - Data transmission over the internet is not entirely secure - We cannot guarantee absolute security despite our efforts - You are responsible for backing up your data - We may access your data for security, legal, or operational purposes - Your data may be stored on secure cloud infrastructure

SthirApp offers a premium subscription at INR 3,000 per year after an initial 1-month free trial.

Subscription Terms: - First month is provided as a free trial - Annual subscription fee: INR 3,000 per year - Payment activation is done manually by the SthirApp team - Subscription renews annually after the free trial period - You will receive a notification before renewal - No automatic recurring charges; manual activation required - Refunds for subscriptions can be processed at our discretion - Price may change with 30 days' notice - Failed or incomplete subscriptions may result in service suspension

All content, features, functionality, design, and materials of the App are owned by SthirApp or its licensors. These are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes. You may not: - Copy, modify, or adapt the App - Sell, rent, lease, or sublicense - Remove any proprietary notices - Use the App's name or trademarks without permission

The App is provided "AS IS" and "AS AVAILABLE" without any warranties or representations. We do not warrant that: - The App will be uninterrupted, error-free, or secure - All information is accurate, complete, or current - The App will meet your specific requirements - Any defects will be corrected

You use the App at your own risk. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, SthirApp shall not be liable for: - Direct or indirect damages - Loss of profits, revenue, data, or business opportunities - Consequential, special, incidental, or punitive damages - Any damages arising from use or inability to use the App - Third-party claims or actions

Our total liability shall not exceed the amount paid by you in the past 12 months.

You agree to indemnify, defend, and hold harmless SthirApp, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - Your use of the App - Your violation of these Terms - Your violation of any applicable law - Your infringement of third-party rights - Any content you provide or transmit - Claims by other users or third parties

You must comply with all applicable laws and regulations regarding lending, data protection, taxation, and financial services in your jurisdiction. You are solely responsible for: - Understanding and following local lending laws - Obtaining required licenses and permits - Collecting and filing required documentation - Complying with interest rate caps and regulations - Maintaining audit trails and records - Following KYC (Know Your Customer) requirements

SthirApp does not provide legal advice. Consult a lawyer for legal compliance matters.

The App maintains comprehensive audit trails including: - User login and logout timestamps - All transactions with date, time, and user details - Data modifications with before/after values - Administrative actions and changes - Failed login attempts and security events - API access logs and data exports

These audit logs are retained for a minimum of 7 years for regulatory compliance and may be accessed by authorized personnel for audit and investigation purposes.

We may terminate or suspend your account immediately if you: - Violate these Terms or our policies - Violate any applicable law - Engage in fraudulent or unauthorized activity - Fail to pay subscription fees - Are unresponsive to communication - Create security risks

Upon termination, your access will be revoked, but data may be retained as required by law.

Any disputes shall be governed by the laws of India and resolved through: 1. Informal resolution: Good faith negotiation for 30 days 2. Mediation: Third-party mediation if negotiation fails 3. Arbitration: Binding arbitration under Indian Arbitration Act, 1996 4. Jurisdiction: Exclusive jurisdiction of courts in India

You waive any right to litigation and agree to arbitration as the sole remedy.

We may modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the App constitutes acceptance of modified Terms. We will notify you of material changes via email or in-app notification.

Your acceptance of the current Terms is documented with a timestamp for audit purposes.

If any provision of these Terms is found invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SthirApp regarding the App and supersede all prior agreements, understandings, and negotiations.

By accepting these Terms and Conditions, you acknowledge that: - You have read and understood all terms - You agree to be legally bound by these terms - You are of legal age and have authority to accept - You will comply with all applicable laws - You accept all risks associated with using the App - You understand your data will be processed as described - You understand our audit and compliance procedures
